Empire Wind granted preliminary injunction allowing construction to resume

The U.S. District Court for the District of Columbia has granted Empire Offshore Wind LLC a preliminary injunction, permitting construction work on the Empire Wind project to resume on the Outer Continental Shelf.


The legal case contesting the U.S. Department of the Interior’s suspension order issued on December 22, 2025, will continue through the courts.


Following the ruling, Empire Wind will prioritize the safe restart of construction activities that were paused during the suspension. The company will also continue coordinating with the U.S. government to ensure its operations are carried out safely, securely, and responsibly.


Developed under a contract with the New York State Energy Research and Development Authority (NYSERDA), the Empire Wind project is intended to provide a vital near-term electricity supply for New York, strengthening grid reliability amid rising demand. Once operational, the project is expected to generate enough power to electrify around 500,000 homes across the state.
